I Spy. You Spy. We All Spy. Is it a crime?





Meet Leon Walker. You'll like him. He's very pleasant, nice looking, well spoken and polite. Smart too. Landed himself a very successful job as a computer technician for Oakland County, the wealthy community north of Detroit, where a lot of the automotive and high tech money is. We call it Automation Alley. Leon, 34 single, and a resident of the tony suburb of Rochester Hills, fits right in.

If law enforcement has its way, though, Leon will soon be a convicted felon. His crime? He snooped in his wife's email. Yep. You read that right. Suspicious that his wife Clara was cheating, he used her password to log onto to her gmail account, and discovered that yes! She was cheating and not just cheating with anyone! Leon was Clara's third husband and he discovered she was cheating with her second husband, a man who had been arrested for beating her in front of a child she shared with her first husband.

If you need to grab a pen and paper just to chart this tawdry mess you may be excused for the moment.

Leon, upon discovering the tryst, immediately notified the first husband, worried about the child Clara and the first husband shared. And since Leon and Clara also shared a young daughter, Leon was also worried about that child as well. It appeared from Clara's email that both children had been exposed to the man Clara claimed had once been violent toward her. The first husband immediately filed for a change of custody and attached the purloined emails to his motion.

Clara, once she realized that her email had been accessed contacted the Oakland County Sheriff's Office. At first, investigators told her it was a civil matter. That was how they handled all such complaints in the past. But Clara, whose persistence is matched only perhaps by her ability to acquire, then discard husbands, continued to complain.

Eventually, the Oakland County Prosecutor's office charged Leon, who has no prior criminal record, with computer hacking, a five year felony. The Detroit Free Press covered the story. The outrage was immediate and worldwide, with thousands of people demanding that the case be dropped and plenty admitting that they too had been guilty of the very felony Leon was now facing.

What makes this case so interesting - above and beyond the deliciously awful facts - is that it is a case study of what happens when law can't keep up with technology. The hacking statute under which Leon Walker is charged was written more than two decades ago, and appears to be designed to prevent employees from walking off with trade secrets or to punish people who steal other people's identities. It is unlikely legislators were anticipating the ongoing reality show that is Clara and Leon. (They have since divorced.)

And snooping - particularly among warring spouses - is not at all uncommon. Just ask any divorce attorney. In fact some experts estimate about 45 percent of divorces involve some sort of clandestine behavior - reading emails, hacking Facebook accounts, opening snail mail, spying. So the Leon Walker case begs a bigger question. How nosey can you be in your marital home?

Leon's pugnascious and highly entertaining attorney, Leon Weiss - who appears to always be on the verge of a cerebral hemorrage over the treatment of his client - trotted the matter up to the Michigan Court of Appeals and at first it seemed he'd found a sympathetic ear, with the higher court issuing a stay, and the judges noting they had "serious concerns" about whether the statute applies to cases of domestic snooping.

But by the time Leon and Leon got before the three membert panel in December for oral arguments, those judges appeared to have a change of heart. Under the strictest reading of the law - you can't access another person's computer or computerized accounts without their permission - Leon's actions might very well be criminal, they said, ordering that the case proceed to trial. It is now set to go befoer a jury in March.

Oakland County prosecutor Jessica Cooper has been steadfast in defending her decision to charge Leon Walker, despite almost universal criticism. The fact that he'd discovered Clara back with a man she once said beat her is inconsequential, she told me in December. And she questioned whether the public reaction would be different if Walker had been snooping in email about Clara's bank accounts, or had been reading email exchanges she might have been having with her divorce attorney. Walker, Cooper says, is a computer hacker who should face the consequences.

So what will twelve of Leon Walker's peers decide when they hear the facts? And what will you do the next time your spouse - or even your kid - leaves a Gmail account open on the screen?

Better think twice.

I know he's facing this insanity and I imagine that if he knew then what he knows now he probably still would have done it because at the end of the day...he ultimately protected two children by having this information. The Oakland County prosecutor should be ashamed of herself utilizing taxpayer dollars for something as petty as this. This is an argument between what was at the time two married people. If they had been divorced and he was reading her email then fine, but this seriously begs to question if the next time my boyfriend and I have a fight...if I should call the Oakland County prosecutor in to settle it for us??

  2. I too agree with What Leo Did. He was protecting his step child and his child. Why hasn't his x that can't seem to keep her legs closed, been charged with ADULTRY? What has not been Mentioned is that husband Number 2 Mike, works at Oakland County Courthouse,where Clara Walker, Leon's X wife worked also. Mike has been in an office in the basement. Clara has gotten around, believe me... Lord only knows what she has on people at this courthouse for things she has done with them. That is why all this is going on. Had it been any other person calling Oakland County it never ever would have gotten to this point. The police would have said "DONT WASTE OUR TIME WITH THIS!" But Ms. Clara obviously pulled someones >>>>>> I mean some strings I am sure holding something over their head! I love this article, if you need to get a pen and paper... LOL! If I were Clara I would be ASHAMED to show my face anywhere. More like EMBARRASSED! I really think this judge needs to worry about the real crimes in Oakland County the real cases... And I think when LEON IS FOUND NOT GUILTY... he needs to be forced to resign...Leon in my eyes and almost the whole worlds eyes you did the right thing, you were married, it was your home computer.. My hats off to you for catching the cheating witch and for protecting two very INNOCENT CHILDREN. SEE THAT JUDGE COOPER... INNOCENT CHILDREN!!!

  3. This husband number two and his x wife have to have some good good contacts for this even to have gotten through the police Department. Someone was calling in a favor for this man to be arrested. I am sure it can be tracked. I understand there have been some changes at the courthouse, these now independent people in the basement ie: Husband #2 they now have to pay for their space where before they didn't. Hmmm is Oakland County covering their asses???? There is a very big story of lies, deceit and the list goes on... I just hope for This man Leon Walker, that had to good sense to protect his child and step child, he is commended for doing so and these prosecutors and the judge are walked to the door with a boot in the A__ on the way out! This is not even a matter for the court system. You get married to become one, it was marital property, and if This Oakland County Prosecutor is so hell bent on prosecuting this man why is he not charging the mother with Child Endangerment on two counts one for each child, and Adultry????? Come on Oakland County answer that question????

  5. Good point about the whole story not being reported by the news media. Perhaps if there was fair coverage, there would be no "outrage" and instead an informed discussion about computer / email / personal device privacy, especially in all types and kinds of marriages nowadays.

    And isn't Leon Walker also charged with illegal access to a county police computer? That fact too is rarely reported.

    It's sad when reporters won't let facts get in the way of the story. Lori, please don't be that kind of reporter!

Really, she spreads her legs around anyone she can, she brings her children around a man who physically abused her that she her self had taken to jail, So obviously she feared for her life if she called the police and had him put in Jail... I mean really...You are delusional if you agree that anyone would agree with this whole thing. He did not have illegal access to a county police computer, The prosecutor admited that in one of his articles. Follow the facts before you write something. Lori is an excellent reporter and she sides with 99.9999 percent of the world. That this case if Bull SHIT and this so called prosecutor is an idiot. Hey when you are married and have kids and your spouse pulls this would you not protect your children? This was a home computer, in a marital home, when you marry you become one, you could pole 100 people and I am sure that they all have snooped...Hell the police departments tell you to get into your childrens facebook, email pictures to make sure they are not endangering themselves. So when I do this am I hacking? Ms. Walker is a disgusting, low life idiot that has called in favors or is doing favors to get this this far, if you can't see it then I feel sorry for you. The FACST are she should have stayed home, took care of her children instead of taking her child over to This 2nd husbands home while she was engaged in sex with him, while the child was there! As for Jessica Cooper, she has no regard for the welfare of children and for that fact alone she should not be in the job she is. She cares nothing about people that put their children in harms way. And as for the troll in the basement, husband no 2... all will come out about him also.

  6. From what I understand the divorce filing came after she realized that she was busted and her first husband filed for custody, which happened AFTER he read her email.

    What's really the story here is that a prosecutor treats the legal system like her own personal toy. Even going as far as making up another charge to retaliate against the same guy that she's already trying to screw over, just beccause she can't handle the spotlight.

    How about Jessie tell the truth about how this charge came about and why her own people are jumping ship.

If Ms Walker had filed already for her divorce as someone stated above, which is not the case, should she not have waited unilt the DIVORCE WAS FINAL to start spreading herself oh yes, that never stopped even when she was married! why do you think these county people are jumping for her...Oh yes sure as >>>>> she has alot of people there she was banging...and threatened to expose if they did not help her with all this. Ask Ms. Walker about a certain Band Member she has slept with, had dinners with, been over to his house in her last two marriages....She is no saint...The other charges against Mr. Walker are bogus and that will be proven...there is alot to come out of the closet yet..and when it does I think alot of people in the county will be scrambling for the door. And as for Mr. Mike J. in the basement of the County Building Husband No. 2 that she was caught cheating with, how is it he has this office there and has never paid a lease agreement until very recently??? All those years as an independent and never had to pay to have an office there???? Not an employee of Oakland County but given full rein of the building and computer information he should not have been able to access??? How many personal records has he pulled for people giving them information on others?

  9. This cockroach of a woman regardless of who filed what first, was wrong in exposing her children to this so called man that beats women. Takes a real man to beat up on a woman...what is he to scared to take it up with a man so he beats women? Regardless, the children are what is important here, Mr. Walker did this to protect the children from this abuser! If you can't see this then your missing the whole point or you like Clara don't care enough about your children or anyone elses. IT'S ABOUT THE CHILDREN PEOPLE!

  10. My guess is that no one is repeating your version of the story because it simple isn't true. The facts of the matter get in the way of your spin. You've got to be unreasonably sympathetic to this serial cheater and child abuser or to the hopelessly incompetent prosecutor to say such nonsense.

    The real story here, and it's really surprising that no one is reporting it, is how someone who has done the nothing but read his wife's email in order to protect his children has been tortured, tormented, bullied, and harassed by the people he work for. This whole mess just stinks of malfeasance.

  11. What I don't get is how Husband No. 1 never speaks. This man protected his child too. So where is this man and why is he not speaking out. From what I have read and can conclude if it were not for Mr. Walker, this mans child would be in danger even to this day. So husband no 1 why have you not spoken out on your position on all this. Afterall, if it were not for Mr. Walker showing you these emails or telling you about them however that went, then your child would be in harms way. I think I would be helping in every possible way I could if someone had saved my child from harm.

  12. He had no right accessing her email without her permission, plain and simple. It's HER property, married or not. It's intellectual property and that is why the Appeals court sided with the Circuit Court. You can protect your children in lots of ways, whether it's legal or not is another story. No, maybe she should not have had her children around the 2nd husband, and maybe she should have waited until the divorce was final before going back with her 2nd husband; that still doesn't make what Mr. Walker did right.

Nor does it make Ms. Walker right, and if Jessica Cooper was not partial in this, she wuld have also had charges aganst Ms. Walker for Adultry, that includes prison time, and child endangerment, two counts of it. So come on Prosecutor, lets be fair here. Ms. Walker has cheated on every husband she has had, where are her charges? It is punishable by law and is the child endangerment. Let's be fair here, He was protecting those chldren that can't protect themselves! WHERE ARE MS. WALKERS CHARGES??????

You are far from being a Saint there too!! I work in the same department as two of the married women he had affairs with.     3. Right, those Oakland County I.T. are highly trained and skilled in the art of reading and signing onto an account.. There should be a Dateline investigation into this "hacker" factory.

      As a matter of fact, each and every complaint against someone for reading another person's email should be retroactively prosecuted. We'll only need to quadrouple our court system capacity to handle all of these "criminals," but it would be well worth it, to justify Jessie's deranged crusade against a husband protecting his child.

      Oh, and please share with us the time and place of your alleged married trists? You work in the same department? Which department is this? Please provide your name as well, I'm sure that his lawyer would be glad to begin civil action against you for fabricating such accusations.

    6. I think this is all very comical, the comments at least, no what is happening to MR. Walker. From what I can tell from this man taking on this fight, and standing tall, he has some cards he has not yet pulled. I have a feeling they are good ones and he just knows how and when to play the cards right. Possibly letting certain people sink themelves father and farth with lies and deceit...He is standing tall, knows he is right and I just have this feeling he will have some big things coming out soon!

  13. Look at you, husband number one, huband number two, husband number three, should have waited, etc.. How messed up are you? The appeals court didn't "Side" with the circuit court, they simply decided not to wade into a politically contentious matter. They're cowards, just like the circuit court judges who refuse to do the right thing.

    You can say that he was "wrong" for reading his wife's email, you're free to have that opinion. But it certainly isn't criminal. It was not criminal when she initially complained and not even a report was filed. It was not criminal when the hundreds of other similar complaints were made and dismissed as a civil matter. But, HER conduct was certainly criminal. Child endangerment, child abuse, perjury, and yes, even adultry is a crime.

    So where is this prosecutor on these matters? There are laws clearly on the boooks for that conduct, yet she's twisting a cyber crime law into something to help a woman in a divorce proceeding? This woman is married and sneaking to take her kids to see another man who BEAT HER AZZ REPEATEDLY in front of at least one of them. WTF are your priorities? Stop lying for her, because you're simply making her worst, putting those kids and their fathers through hell.

It's truly sad when what is getting lost in all this is the fact that we have this SO CALLED mother, who personally is not fit to be a mother, who endangers these children by bringing them around an abuser, and Oakland County Prosecutors, SHOW NO CONCERN THE CHILDRENS WELL BEING OR TRY TO PROTECT THESE CHILDREN, from an abuser. But remember, this abuser works in this very courthouse as an "independent". If I were Mr. Walker I would not even have this tried in Oakland County - This is a civil matter if anything. Many others have been told it's a civil matter, as Ms. Walker was at first, but after a few favors were called in Mr. Walker was arrested. This will all be proven in court. This still does not excuse the fact that this Ms. Cooper has not filed the charges against this Ms. Walker, for child endangerment. Looking on the books Adultry is punishable here too, why haven't charges been filed on that also? Ms. Cooper needs to take a long hard look in the mirror and say is my priority these children or could I care less about the children? Because so far she has done NOTHING to protect the most important element of this, that Mr. Walker is the only one who has, THE TWO MINOR CHILDREN! My hats off to you Mr. Walker, you keep fighting for these children, someone needs to. It's clear your Oakland County Prosecutors, and Judges won't and even sadder their mother doesn't have the good sense to protect them. You Go Mr. Walker, the world is on your side!

    2. Good grief, folks. I posted this blog because I thought it was an interesting issue and would provoke some important debate about technology and law. Believe me, I have no agenda here at all. I just cover this stuff as part of my job. Catch my next posting later this week - A Drinking Woman's Guide to Housekeeping. It's a little more fun than this topic and I hope it makes you all laugh, regardless of where you stand on the Leon Walker issue.

    If you're correct, then he's guilty of identity theft and the penalty for it is whatever the penalty is.

    1. ErikBlaine you make sense. But Loritellsastory helped spin the Leon Walker story over the past year, so her job is to keep it going. Says alot about the Free Press editors IMO. Also says alot about her claim of "no agenda".
